Conditions of Entry
1. Contest: This Xplor Horizons Contest (“Contest”) is conducted by MYXPLOR PTY LTD Level 3, 520
Bourke Street, Melbourne, Victoria, 3000 (“Xplor Education”). Xplor Education is conducting a
promotional contest, under which eligible Xplor Education and QikKid customers have the
opportunity to be win flights and accommodation up to the value of $2,000 AUD (total) by
registering customers for the Xplor Horizons Conference before 23 July 2025. The event is to be held
in Melbourne on 18 September 2025.
2. Eligibility: Entry is open to individuals who are residents of Australia and aged 18 years or over at the time of entry. To be eligible, entrants must be a current customer of Xplor Education or QikKids. Employees of Xplor Education, its related bodies corporate, and members of their immediate families (including spouses, de facto partners, parents, children, and siblings) are ineligible to enter. The competition is open to eligible residents of all Australian states and territories. Each entrant is permitted to submit only one (1) entry.
3. Agreement to Terms: Instructions and information on how to enter form part of these Conditions of Entry. Participation in this Contest constitutes acceptance of these Conditions of Entry. By entering, entrants represent and warrant that they meet the eligibility requirements and have obtained all necessary approvals to submit an entry on behalf of a centre that is a current Xplor Education or QikKids customer with a current written Xplor Education or QikKids agreement in place. Entrants agree to these Conditions of Entry on behalf of the relevant Xplor Education or QikKids customer centre. The decision of Xplor Education is final, and no correspondence will be entered into.
4. Submission Period: Entries will be accepted from 12:00 am on 2 JULY 2025 AEST until 11.59 pm on 23 JULY 2025 AEST. Entries/Registration must be received before the end of the Submission Period.
5. How to Enter:
(a) During the Submission Period, entrants must:
(i) Register via the event landing page and/or luma event page, confirming their intention to participate and attend the event.
(b) Entries are deemed to be received at the time they are received by Xplor Education’s database and not at the time of submission by the entrant.
(c) Entrants may only submit ONE (1) entry but multiple entries may be submitted per Xplor Education or QikKids customer service centre.
(d) Xplor Education has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. Xplor Education is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple user accounts or aliases may be disqualified. Entrants and Centres are responsible for their own costs associated with accessing the Internet.
6. Contest Guidelines:
(a) Entries must comply with the following Contest Guidelines. Any entry that does not comply with the Contest Guidelines will be deemed invalid and ineligible to enter this Contest.
(b) Entries must:
(i) not contain violence or promote discrimination against any individual or group or otherwise contains content that, in the view of Xplor Education or QikKids, is inappropriate;
(ii) submitted in accordance with these Terms and Conditions and Conditions of Entry.
(c) In the event Xplor Education deems in its absolute discretion that any or all entries are incomplete or not in accordance with these Conditions of Entry or Contest Guidelines or are otherwise deemed to be unsuitable, Xplor Education reserves the right to disqualify such entries and to not determine any Winner(s).
7. Winner Determination:
(a) Winner(s): Xplor Education will determine ONE (1) Winner.
(b) The winner will be determined by a random electronic draw from all eligible entries received. The draw will be conducted at 10:00am AEST on 24 July 2025 at the offices of Xplor Education, located at Level 3, 520 Queen Street, Melbourne VIC 3000.
(c) The selected winner will be notified by both email and telephone within two (2) business days of the draw. If the winner does not respond to the notification within seven (7) days, a redraw will be conducted under the same conditions at the same location on 30 July 2025.
(d) If the redraw winner does not respond within seven (7) days of being notified, Xplor Education reserves the right, in its absolute discretion, to conduct further redraws as necessary or to cancel the prize.
8. Prizes:
There will be one (1) winner selected from all eRligible entries received. The prize consists of:
(a) return domestic economy-class airfares for one (1) person from any Australian capital city to the event location; and
(b) two (2) nights' accommodation (17 and 18 September 2025) in a minimum four-star hotel, as determined by Xplor Education in its sole discretion. The total maximum retail value of the prize is AUD $2,000 (inclusive of GST). The flights and accommodation will be booked and paid for directly by Xplor Education.
(c) The prize is strictly non-transferable, non-refundable, and not redeemable for cash, credit, or any other alternative. The prize must be used solely for attendance at Xplor Horizons 2025. The winner must attend the event in full in order to remain eligible for the prize. Failure to attend the event will result in forfeiture of the prize, and no alternative compensation will be provided.
(d) In the event the winner cancels or withdraws from attending the event within fourteen (14) days prior to its commencement (i.e. on or after 3 September 2025), the prize will be forfeited, and no alternative prize or compensation will be offered. Xplor Education reserves the right to cancel any flight or accommodation bookings in such circumstances. Where cancellation fees or non-refundable costs have been incurred by Xplor Education prior to cancellation, these may be deducted from the prize value or charged directly to the winner.
(e) Any costs in excess of the maximum prize value, or costs not expressly included in the prize description—such as transfers, ride shares, meals, insurance, or any other personal or incidental expenses—are the sole responsibility of the winner. Any unused portion of the prize will be forfeited and is not redeemable for cash, credit, or vouchers.
9. Winner Notification:
(a) Winner(s) will be notified via email on or around 15 AUGUST 2025.
(b) To the extent permitted by law, Xplor Education shall have no liability for:
(i) any Winner’s failure to receive notices due to spam, junk email or other security settings or for the provision of incorrect or otherwise non-functioning contact information;
(ii) any Winner’s inability to receive or participate in any prize component.
(c) If, after making all reasonable attempts, Xplor Education cannot contact the Winner(s) within one (1) week of notification by Xplor Education, that entry will be deemed invalid and Xplor Education will determine the next best valid entry in accordance with these Conditions of Entry as are necessary to distribute the relevant prize.
10. General Conditions
(a) Xplor Education reserves the right to verify the eligibility of all entrants and may, in its sole discretion, disqualify any entrant who does not comply with these Terms and Conditions or who tampers with the entry process.
(b) Xplor Education accepts no responsibility for late, lost, misdirected, incomplete, or invalid entries, whether due to technical disruptions, delays, or any other reason beyond its control.
(c) Xplor Education reserves the right to amend these Terms and Conditions at any time, subject to applicable state or territory legislation and approval requirements, where relevant.
(d) If Xplor Horizons 2025 is cancelled, postponed, or materially altered for reasons beyond the reasonable control of Xplor Education, it reserves the right to amend, postpone, or cancel the prize accordingly, with no liability to provide alternative compensation.
(e) Xplor Education is not responsible for any travel delays, service interruptions, or circumstances beyond its control, including but not limited to airline disruptions, accommodation issues, or force majeure events, that may impact the winner’s ability to attend the event or utilise the prize.
11. Liability and Governing Law
(a) (i) To the maximum extent permitted by law, Xplor Education excludes all liability for any loss, damage, or injury (including indirect or consequential loss) suffered or sustained in connection with the conduct of the competition or the awarding or use of the prize.
(b) This competition is governed by the laws of Victoria, Australia. All entrants agree to submit to the exclusive jurisdiction of the courts of Victoria in relation to any legal proceedings arising from or related to this promotion.
12. Other:
(a) By submitting an Entry, entrants:
(i) understand and consent to Xplor Education, anyone acting on behalf of Xplor Education and Xplor Education’s licensees, successors and assigns, having the right, where permitted by law, to copy, print, publish, broadcast, distribute and use in any media or otherwise exploiting the entry and any rights in relation to the entry for any other purposes now known or hereafter developed, in perpetuity and throughout the World, without limitation, your Entry, first name, and statements about this Contest, for news, publicity, information, trade, advertising, public relations and promotional purposes without any further compensation, notice, review or consent.
(ii) represent and warrant that their Entry is an original work of authorship by them and does not violate any third party’s proprietary or intellectual property rights. If an Entry infringes upon the intellectual property right of another, the relevant entrant will be disqualified at the sole discretion of Xplor Education. If the content of an Entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, that entrant shall, at their sole expense, defend or settle against such claims.
(iii) grant Xplor Education a world-wide, royalty free, perpetual, irrevocable, transferrable licence (with a right to sublicense) to use their entry (including their photograph) submitted as part of this Contest for any purpose;
(iv) permit Xplor Education to edit, adapt and alter all entries for inclusion on its communications, including in its emails, on its social media channels (Facebook, Instagram and LinkedIn).
(v) acknowledge that their entry and their name may be made publicly available by Xplor Education (in its absolute discretion) and will be accessible to the general public to view;
(vi) warrant that they own or have the right to license the copyright in any entry submitted by them into this Contest, for the purposes of this Contest, that no rights have been granted to any third party in respect of any such entry which would prevent the entry being used as contemplated by this Contest, and that the use by Xplor Education of any such entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and defamation);
(vii) warrant that any person featured in any photograph/video has consented to the entrant submitting that photograph/video into this Contest;
(viii) warrant that their entry does not include any content that contravenes any law, infringes the rights of any third party, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate or makes any improper or inappropriate invasion of the privacy of any person. Without limitation, entrants must not include any content that involves nudity, malice or which may be defamatory or in contempt of court;
(ix) warrant that their entry does not include any literary, dramatic or artistic work, or any other item in which copyright subsists, unless the entrant is entitled to do so;
(x) warrant that their entry contains no virus or other computer code or material embedded in it which may have a negative impact on any network or third party computer systems; and
(xi) warrant that all persons appearing in their photograph/video are 18 years of age or older or, if any person is under 18 years of age, that their parent’s or guardian’s consent has been provided.
(b) Each entrant will receive a return online confirmation their successful entry into this Contest. By entering this Contest, entrants consent to receiving this electronic message.
(c) Xplor Education is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.
(d) Xplor Education may require Winner(s) to provide proof of identity, proof of employment, proof of age and proof of residency. Identification considered suitable for verification is at Xplor Education’s discretion.
(e) Xplor Education may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Contest by, any person (including without limitation the Winner(s)) who tampers with or benefits from any tampering with the entry process or with the operation of this Contest or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of Xplor Education or any of its related bodies corporate or the agencies or companies associated with this Contest, is contrary to law or is otherwise inappropriate.
(f) Xplor Education and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or the acceptance or use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum extent permitted by law). Nothing in these Terms and Conditions excludes, restricts, or modifies, or purports to exclude, restrict, or modify, any consumer guarantees under the Competition and Consumer Act 2010 (Cth) or any other applicable legislation, to the extent such guarantees cannot be lawfully excluded.
(g) Xplor Education may communicate or advertise this Contest using Instagram, Facebook or any other social media platforms. However, this Contest is in no way sponsored, endorsed or administered by, or associated with these platforms. Entrants are providing their information to Xplor Education only and not to these platforms. Each entrant completely releases all social media platforms from any and all liability.
(h) Xplor Education accepts no responsibility for any tax implications that may arise from prize winnings. Entrants are solely responsible for seeking independent financial or tax advice regarding any obligations, including but not limited to income tax or Goods and Services Tax (GST). Where the receipt of a prize constitutes a taxable supply for GST purposes, the winner may be required to disclose the fair market value of the prize in accordance with guidance provided by the Australian Taxation Office (ATO).
13. Privacy Policy:
Xplor Education collects information from entrants (such as name, email, phone number, centre details and any other details provided in entering this Contest) in order to conduct this Contest and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers to assist in conducting this Contest. Entry to this Contest is conditional on providing this information. This section should be read in conjunction with Xplor Education’s Privacy Policy, which explains how it collects, stores and uses personal information, which also sets out your data protection rights, including access and correction and how you may complain or raise a query about our handling of your information. Depending on the entrant’s location, information may be disclosed by Xplor Education outside your jurisdiction as contemplated in these Terms.
